CrPC Section 355 (Metropolitan Magistrate's judgment) was not carried into the BNSS

Code of Criminal Procedure, 1973 · applies to offences and proceedings before 1 July 2024

NCRB's official correspondence table lists CrPC 355 as deleted (page 39), and BPR&D's gives it no BNSS counterpart. There is no provision of the Bharatiya Nagarik Suraksha Sanhita, 2023 that replaces it.

CrPC 355: Metropolitan Magistrate's judgment

Before 1 July 2024

Instead of recording a judgment in the manner hereinbefore provided, a Metropolitan Magistrate shall record the following particulars, namely:—

(a) the serial number of the case;

(b) the date of the commission of the offence;

(c) the name of the complainant (if any);

(d) the name of the accused person, and his parentage and residence;

(e) the offence complained of or proved;

(f) the plea of the accused and his examination (if any);

(g) the final order;

(h) the date of such order;

(i) in all cases in which an appeal lies from the final order either under section 373 or under sub-section (3) of section 374, a brief statement of the reasons for the decision.

Which one applies

Procedure follows the proceeding. Under section 531(2)(a) of the BNSS, an appeal, application, trial, inquiry or investigation already pending on 1 July 2024 continues under the CrPC; one begun on or after that date proceeds under the BNSS.

Judgments decided under CrPC 355

They still govern offences committed before 1 July 2024. With no BNSS counterpart, they do not carry forward.
