CrPC Section 27 (Jurisdiction in the case of juveniles) was not carried into the BNSS
Code of Criminal Procedure, 1973 · applies to offences and proceedings before 1 July 2024
NCRB's official correspondence table lists CrPC 27 as deleted (page 21), and BPR&D's gives it no BNSS counterpart. There is no provision of the Bharatiya Nagarik Suraksha Sanhita, 2023 that replaces it.
CrPC 27: Jurisdiction in the case of juveniles
Before 1 July 2024
Any offence not punishable with death or imprisonment for life, committed by any person who at the date when he appears or is brought before the Court is under the age of sixteen years, may be tried by the Court of a Chief Judicial Magistrate, or by any Court specially empowered under the Children Act, 1960 (60 of 1960), or any other law for the time being in force providing for the treatment, training and rehabilitation of youthful offenders.
Which one applies
Procedure follows the proceeding. Under section 531(2)(a) of the BNSS, an appeal, application, trial, inquiry or investigation already pending on 1 July 2024 continues under the CrPC; one begun on or after that date proceeds under the BNSS.
Read BNSS section 531 →Judgments decided under CrPC 27
They still govern offences committed before 1 July 2024. With no BNSS counterpart, they do not carry forward.
